DESCRIPTION:  \nWith all the hype around the opportunities and challenges presented by Artificial Intelligence\, more and more focus is being paid on where the content that AI regurgitates actually comes from. There have been a growing number of complaints about companies that are ‘’training” their AI systems using data that does not belong to them. The concerns were expressed by a broad range of professionals\, including writers\, artists\, composers\, etc. After researchers built a system to write computer programs\, picking up strings of code from an untold number of programs posted to the internet\, another group of professionals joined the protesters\, software writers.\nCourts are trying to establish how intellectual property laws should be applied in cases of self-writing software\, and several cases have already been filed. To protect themselves from these risks\, software companies that use generative AI need to ensure that they are in compliance with the law and take steps to mitigate potential risks\, such as ensuring they use training data free from unlicensed content or they pay for the licenses – a goal that is not easy to accomplish if your AI goes fishing in the vast data pools of the internet. \nOur panel will discuss the many open questions about self-writing software and copyrights. Milla also regularly counsels clients on the impacts of current and potential new trade negotiations\, including the US-Mexico-Canada Agreement (USMCA) and US-Japan and -EU talks. \nPrior to law school\, Milla was the special assistant to the chairman of the White House Council on Environmental Quality\, where she gained first-hand experience in the daily operations of the executive branch. While at the council\, she worked closely with the chairman and his team of policy advisors in the development and management of significant administration policies and programs\, such as the Major Economies Meetings on Energy Security and Climate Change. \nWhile in law school\, Milla served as the assistant to former White House Counsel and former US Ambassador to the European Union C. Boyden Gray. She was elected as a vice president on the executive board of the Student Bar Association\, where she represented part-time student interests. Additionally\, she was an active member of the Georgetown Journal of Law & Public Policy staff\, where she served as a symposium director. \n  \n \nJoe Kulenovic is responsible for managing Florida’s network of 19 trade and investment promotion offices outside the United States\, as well as leading efforts to attract foreign direct investment into the state. He previously served as Enterprise Florida’s Chief Economist and head of its Research Department for over a decade. \nOther career highlights include working as Research Director for public-private partnerships for the US Agency for International Development\, consulting for the Inter-American Development Bank and the European Union\, and a total of about nine years with the World Bank Group\, in a variety of functional roles. At the World Bank\, he led work on detailed case studies of economically competitive cities around the globe\, seeking to understand their success in fostering broad-based economic growth and creating jobs. He also designed and/or implemented World Bank projects in urban transport\, local and regional economic development\, and building institutional capacity at economic development organizations/investment promotion agencies. With close to three decades of professional experience in international trade and development\, Kulenovic has worked in or with more than 30 countries on all continents. \nKulenovic holds a Bachelor’s degree in Interdisciplinary International Studies from the University of Belgrade\, and a dual Master’s degree in Economics and International Relations from The Johns Hopkins University – The Paul H. Nitze School of Advanced International Studies (SAIS) in Washington\, DC\, and Bologna\, Italy. Having lived in nine countries on four continents\, he has a working knowledge of several languages. \n  \nMichelle Sadeghy is a Manager on the Tax Credits & Incentives Practice within the Tax Services Advisory Group of Kaufman Rossin. As a mechanical engineer with a background in energy efficiency in commercial buildings\, she helps clients qualify for various energy credits and incentives\, including the 179D deduction for energy-efficient commercial buildings and the 45L energy-efficient home credit for developers. She brings over a decade of experience as a project manager and energy modeler for design and construction teams. She has worked on over 40 Leadership in Energy and Environmental Design (LEED) projects and provided energy design consulting on over 300 projects. She earned her Bachelor of Science in Environmental Engineering from the University of Colorado Boulder. She is a Licensed Professional Mechanical Engineer (PE) in Florida and California and a National Green Building Standard (NGBS) Verifier. She is also a graduate of the Urban Land Institute (ULI) Leadership Institute and an active member of ULI. \n  \nPeter Stratos is a principal in Kaufman Rossin’s International Tax department where he provides extensive knowledge to his clients on international tax planning for both individual and corporate taxes. Peter’s primary expertise in international tax is in the areas of foreign tax credit planning\, residency issues\, state and local issues for international and multinational businesses\, ex-pats and inpats\, pre-immigration planning\, transfer pricing\, compensation planning\, treaty positions\, entity selection\, organizational structuring and withholding issues. DESCRIPTION:  \nThe European Union (EU) introduces a groundbreaking policy: the Carbon Border Adjustment Mechanism (CBAM). \nCBAM\, a strategic initiative designed to harmonize the EU’s ambitious climate objectives with international trade practices. By addressing the complexities of carbon leakage and establishing a level playing field for domestic and foreign producers\, CBAM marks a significant step in the EU’s journey towards a sustainable future. \nThis mechanism aims to cut greenhouse gas (GHG) emissions by at least 55% by 2030\, advancing towards climate neutrality by 2050. Aligned with the EU Emission Trading System (EU ETS)\, CBAM forms part of the “Fit for 55” package\, specifically addressing the risks of carbon leakage – a phenomenon where production migrates outside the EU due to varied emission costs. \nPreviously\, to mitigate carbon leakage\, certain industries received free emission allowances under the EU ETS. However\, CBAM introduces a paradigm shift. It aims to level the playing field by imposing comparable carbon costs on imports from non-EU countries\, focusing on sectors at high risk of leakage\, such as cement\, iron\, steel\, aluminum\, fertilizers\, hydrogen\, and electricity\, including certain related products. \nCBAM’s rollout involves two phases: a transitional period (October 2023 to December 2025) focusing on data reporting without financial implications\, followed by a definitive period commencing January 2026. In the latter phase\, embedded emissions will gradually come under CBAM obligations\, with free allowances phased out by 2034. This approach mirrors the EU ETS\, requiring EU operators to pay for emissions and importers to acquire CBAM certificates reflecting EU ETS prices. Compliant with World Trade Organization regulations\, CBAM uniformly applies to all imports from outside the EU. \nOur panel will help us better understand how CBAM will affect US companies and how to prepare effectively for this important policy change. \nI. In both the Euro Area and EU as a whole\, GDP expanded 0.3% as Germany returned to growth and Spain\, Ireland\, and the Baltics (among others) reported strong expansions. These green shoots are welcome following a challenging 2023 in the EU and growth is expected to gradually pick up over the course of the year as the headwinds from tight financial conditions fade and falling inflation along with a still solid labor market helps boost real disposable income. The growth divergence between the US and EU that marked 2023 is already closing\, with the US just barely growing faster than the EU (0.4% to 0.3%) over the first three months of the year. \nYet 2024 holds a few uncertainties on both sides of the Atlantic. Financial conditions remain restrictive\, with both the ECB and the Fed\, focused on incoming inflation and labor market data as they assess any potential changes to their monetary policy stances. Supply chains are being reshaped as firms and policy makers aim to improve resilience and promote investment in critical economic sectors. \nBoth the EU and the US will hold consequential elections this year – the EU in June and the US in November.
